Learning outcomes

What is the relationship between law and economics? How does the functioning of economic system is affected by law, and how does the economy affect the legal system? What are the necessary legal rules and institutions for the development of a market-based economic system, and what are the rules and institutions that instead impede such development? These are some of the fundamental questions that are addressed by the course. The latter aims at providing students with the basic instruments to understand the role of law in the economic realities of inter-subjective realities, and of a local, national and international nature.

Syllabus

Part A
General themes

1) The functions of law in the economy: allowing, promoting, correcting and overcoming the market.
2) The Italian Economic Constitution and the European Union. Forms, objectives and limits of public intervention in the economy.
3) Law and the process of economic globalization.

Part B
Special themes
1) Economic systems: definition and types. Growing affirmation of market economies at the national and supranational level.
2) The functions of law and public authorities in market economies.
3) The failures of public intervention in the economy.
4) The economic project of the European single market. The protection of economic freedoms and competition from the restrictive and anti-competitive measures of individuals and states.
5) Liberalization and privatization.
6) The regulation of financial intermediation services in the European market.
7) Public services between competition and regulation, between public companies and private companies.
8) The economic functions of the cds independent authorities
9) The right to trade between individuals and between states: private and public profiles.
10) International regulation of public procurement.
