By reflecting on the origin and the principles of law and jurisprudence, the course aims to provide students with the instruments for a critical approach to formalism and normativism. The educational pathways will be developed with regard to some key-questions in the philosophy of law, from the ancient Greek thought to the modern legal positivism and its crisis.
The course focuses on three issues:
- Justice and legal norm: the relationship between these notions will be analysed by means of some classical texts of 20th century legal positivism
- Justice and political society: the social dimension of justice and its anthropological roots will be analysed by means of a classical philosophical text
- Justice and legal case: the relationship will be analysed moving from a contemporary inquiry about the origin of law.
