The first part of the course deals with Source of law and Jurisdictional function under Italy’s Constitution.
The second part deals with the national and international sources of Fundamental Rights and will focus a selected cases of ECHR and national constitutional courts with relevance to the impact of fundamental rights.
Part I: Source of law. Sources' rules of production and enactment. The legal source system. The Constitution. Legislative statutes. European and international sources. Delegated legislation. The regional legal sources. Executive acts. The normative facts.
Jurisdicional function: judge and public prosecutor; the independence of the judiciary in the Italian Constitution. The civil liability of the members of the judiciary. The Superior Council of the Judiciary.
Part. II: Fundamental rights
Fundamental rights of Italian Constitution
The protection of fundamental rights in Europe
Attending students will be entitled to take a multile choice test and open-ended questions.
For non-attending students final exam consists of a general oral exam.
