The essay concerns the “pactum de non petendo”, the agreement according to which the creditor renounces to ask the debtor the fulfillment of his obligation. Firstly, the analysis will explain the difference between the p. d. n. p. and other legal transactions (such as the release). Then the article will concentrate on the structure of the p. d. n. p., focusing in particular on the idea of p. d. n. p. as a waiver of the enforceability of the claim. Finally, the presentation of the court case of the Vajont disaster will lead to speaking about the p. d. n. p. in joint and several obligations.
