Descrizione: The current Code of Criminal Procedure redeems victim of the offence from his secondary role in regard of the State punitive claim and recognises to the victim specific rights and faculties. Victim’s role was particularly strengthened by the Law which has introduced the criminal jurisdiction of the Justice of the Peace. However, the criminal procedural system shows so many lacks to bring the Italian Legislator planning measures for a more effective protection of the victim (such as the proposal “Framework Law for assistance and protection of the victims of offence”, currently under resolution of the Parliament), according to the indications by the international Community (such as the framework Decision of the Council of the European Union of 15 March 2001 on the standing of victims in criminal proceedings).
