Learning outcomes

Objectives
The course studies an important area of criminal law , which is relevant in today’s society, for the economic and social life, and is subject to changes in the business world, included the labour market and the consumer world.
The student will analyze the criminal offences against the public economy (Tit. VIII of the special part of the criminal code – Codice Rocco of 1930, which is formulated in the old public perspective)
In this sense the student will study its adaptation to the Italian Constitution, analyzing 3 groups of criminal offences: crimes difficult to apply, against the national economy (in particular related to the Fascist experience); strike and “serrata” criminal offences, which punish “residual” cases, survived after the Constituion; actual and most applicable criminal offences, also recently reformed, that criminalize illegal, fraudulent and dangerous activities for the market and the fair competition, for the industrial property and the rights of the consumers.
The second part of the course will study the criminal liability of persons with specific qualifications inside the company, with particular attention to the “delega di funzioni” (delegation of functions) and some important criminal offences provided by civil code and special law (fraudulent corporate accounting practices and crimes against safety and healt at work, provided by d.lgs 81/2008)
