- On 31st March 2011 the Constitutional Court of Czech Republic annulled the law transposing the Data Retention Directive (2006/24/EC) on the basis that it was unconstitutional.
This judgement dealt with matters similar to the ones which have been the object of the recent decisions of the Bundesverfassungsgericht (2010) and the Romanian Curtea Constituţională (2009) and they have raised the question: are data retention rules under attack in the European Union? The work will answer to the question, taking into account the evaluation report on the “Data Retention Directive” of the EU Commission and the perspectives after the Treaty of Lisbon.
